Sample ICRAA Notification

The following page contains an editable sample notification required under the California Investigative Consumer Reporting Agencies Act, Civil Code §1786, et seq. (“ICRAA”).  Under ICRAA, landlords and agents are required to provide a notice to rental applicants if they have requested an investigative consumer report about the applicant. Specifically, Civil Code §1786.16(a)(3) provides:

If an investigative consumer report is sought in connection with the hiring of a dwelling unit, as defined in subdivision (c) of Section 1940, the person procuring or causing the request to be made shall, not later than three days after the date on which the report was first requested, notify the consumer in writing that an investigative consumer report will be made regarding the consumer's character, general reputation, personal characteristics, and mode of living. The notification shall also include the name and address of the investigative consumer reporting agency that will prepare the report and a summary of the provisions of Section 1786.22.

Notification Pursuant to the California Investigative Consumer Reporting Agencies Act (“ICRAA”) Section 1786.16(a)(3)

______________________ (FILL IN LANDLORD OR AGENT NAME) (“Landlord”) may request, for residency decisions where you, as a consumer, are located in California; the rental/lease property is located in California; or the rental/lease decision is made in California, background information about you from an investigative consumer reporting agency in connection with your rental application in the form of an investigative consumer report.  Under California law, an “investigative consumer report” is a consumer report in which information on a consumer's character, general reputation, personal characteristics or mode of living is obtained through various means, the most common of which is checking personal or professional references. These reports may be obtained at any time after receipt of your authorization and, if you enter into a rental/lease agreement with the Landlord, throughout your rental/lease period, as permitted by law.

The investigative consumer report may contain information bearing on your character, general reputation, personal characteristics or mode of living, and may be used or expected to be used or collected in whole or in part for the purpose of serving as a factor in establishing your eligibility for residency.  The types of information that may be obtained include, but are not limited to: social security number verification; address history; criminal records and history; history of housing court records; public court records; bankruptcy filings; personal and professional references checks; and other information bearing on your character, general reputation, personal characteristics, mode of living and credit standing.

This information may be obtained from private and public record sources, including: government agencies and courthouses; personal interviews with sources such as neighbors, friends, former employers and associates; and other information sources.
