First-Time Screening PRO Incentive - Terms and Conditions

RentSpree’s First-Time Screening PRO Incentive (the “Program”) begins on May 29, 2025 at 12:00 a.m. PT and ends on June 13, 2025, at 12:00 a.m. Sponsor’s computer is the official timekeeping device for this Program.

BY PARTICIPATING IN THE PROGRAM, YOU AGREE TO COMPLY WITH THESE TERMS AND CONDITIONS WHICH INCLUDE CLASS ACTION AND JURY TRIAL WAIVERS AS WELL AS PROVISIONS PROVIDING FOR MANDATORY BINDING ARBITRATION, A LIMITATION OF YOUR RIGHTS AND REMEDIES, AND INDEMNIFICATION.

RentSpree, Inc. ("RentSpree") may offer registered users (“Users”) of RentSpree’s service ("Service") the opportunity to participate in its First-Time Screening PRO Incentive (the “Program”). The Program provides eligible Users with a promotional code for two (2) free months of RentSpree PRO, subject to the terms and conditions set forth below (these “Terms”).

By participating in the Program, you agree to use the Program in the manner set out in these Terms and agree that you are bound by these Terms as well as RentSpree’s Privacy Policy and Terms of Service. If you do not agree to any of the foregoing in their entirety, you may not participate in the Program. You may not participate in the Program where to do so is prohibited by applicable law. 

RentSpree reserves the right at any time and in its sole discretion to (i) terminate or modify the Program; (ii) modify or amend these Terms including the methods by which rewards are earned; and/or (iii) disqualify you from participation in the Program if you violate these Terms.

1. PRIVACY. Information submitted in connection with this Program will be collected, processed and used in accordance with RentSpree’s Privacy Policy. In addition, personal information may be used by RentSpree to contact you about the Program, and you agree to receive emails from RentSpree. You may unsubscribe from Program emails at any time by using the unsubscribe link at the bottom of any Program email.

2. HOW THE PROGRAM WORKS. To qualify for a reward under this Program, you must complete a tenant screening through RentSpree’s Service within fourteen (14) calendar days of receiving the Program invitation via email. Completion of a tenant screening requires the following steps:

1. Add a property to your RentSpree account,
2. Generate an application link for that property,
3. Share the application link with at least one prospective renter, and
4. Receive a completed screening report from at least one renter through the shared application link.

All steps must be completed using RentSpree’s platform within the 14-day offer window following receipt of the Program invitation email.

Once RentSpree verifies that the above requirements have been fulfilled, you will receive a promotional code via email to redeem two (2) free months of RentSpree PRO. The code will be delivered within 45 days of completing the qualifying activity. Limit one (1) reward per eligible user.

• Be at least 18 years old;
• Be a legal resident of the United States;
• Have received a direct invitation from RentSpree to participate in the Program;
• Not be an employee, contractor, or agent of RentSpree, or its affiliates, subsidiaries, or promotional partners.

RentSpree reserves the right to verify eligibility and disqualify users who do not meet these requirements. All rewards are subject to verification by RentSpree. RentSpree's decisions with regard to the Program are final and binding, including decisions as to whether a first-time screening is verified. RentSpree may delay a reward for verification. RentSpree may also refuse to verify and process any transaction RentSpree deems, in its sole discretion, to be fraudulent, suspicious, in violation of these Terms or believe will impose potential liability on RentSpree, its officers, directors, employees, representatives, affiliates and agents. For example, you may not create multiple or fake accounts with RentSpree or participate in the Program using multiple or fake email addresses or identities.

4. LIABILITY.  By participating in the Program, you agree to: (A) defend, indemnify, release and hold harmless RentSpree and its employees, directors, officers, licensees, licensors, shareholders, attorneys, affiliates and agents (collectively, the "Released Parties"), from any and all claims, actions, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to your participation in the Program (including, without limitation, any property loss, damage, personal injury or death caused to any person(s) and/or the awarding, receipt and/or use or misuse of the Program); and (B) be bound by these Terms, the decisions of RentSpree  and RentSpree’s Privacy Policy and Terms of Service.

5. LIMITATION OF LIABILITY. YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (A) TO THE FULLEST EXTENT POSSIBLE BY LAW, RENTSPREE'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY, OR OTHERWISE), WILL NOT EXCEED $100; AND (B) RENTSPREE  WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF RENTSPREE WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) THE USE OF, OR THE INABILITY TO USE, THE PROGRAM; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH, FROM, OR AS A RESULT OF THE PROGRAM; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON OR THROUGH THE PROGRAM; OR (V) ANY OTHER MATTER RELATING TO THE PROGRAM. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusions of liability for incidental or consequential damages. Accordingly, some of the above limitations in this paragraph may not apply to you.

6. DISCLAIMER OF WARRANTIES. YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (A) YOUR USE OF THE PROGRAM IS AT YOUR SOLE RISK, THE PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND RENTSPREE EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND TERMS OF ANY KIND, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, WARRANTIES AS TO PRODUCTS OR SERVICES OFFERED THROUGH THE USE OF THE PROGRAM, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) RENTSPREE MAKES AND GIVES NO WARRANTY THAT (I) THE PROGRAM WILL MEET YOUR REQUIREMENTS, (II) BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, (III) THE RESULTS OBTAINED FROM THE USE OF THE PROGRAM WILL BE ACCURATE OR RELIABLE, (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE PROGRAM WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE PROGRAM WILL BE CORRECTED; AND (C) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PROGRAM ARE ACCESSED AT YOUR OWN RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL.

RentSpree shall not be liable for:

• Telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors
• Data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials
• Any printing, typographical, administrative or technological errors in any websites or materials associated with the Program
• Claims, demands and/or damages in disputes among users of the Program
• Failure to provide the Program or supply any reward or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened terrorist acts or terrorist acts

Users agree not to use the Program to:

• Violate applicable law
• Infringe the intellectual property rights of RentSpree or any third parties
• Stalk, harass or harm another individual
• Send messages containing obscene, profane or otherwise inappropriate language
• Impersonate any person or otherwise misrepresent your identity
• Interfere with, disrupt or violate the Terms or servers or networks connected to the Program, or disobey any requirements, procedures, policies, or regulations of such networks
• Attempt to gain unauthorized access to the Program, other accounts, computer systems or networks connected to the Program
• Transmit any file that contains viruses, worms, Trojan horses, or any other contaminating or destructive features
• Initiate any bulk email distribution, distribution to strangers, or any other promotion in a manner that would constitute or appear to constitute unsolicited commercial email or "spam" in RentSpree's sole discretion

Any and all disputes, claims, and causes of action arising out of or related to the Program shall be resolved under California law (without reference to its conflicts of laws principles), and all participants in the Program agree to submit any dispute exclusively to arbitration before a single arbitrator at JAMS. Any such arbitration, to the extent necessary, shall be conducted in Los Angeles, California. Participants covenant not to sue RentSpree in any other forum.

By participating in the Program, you acknowledge and understand that, with respect to any dispute with the Released Parties arising out of or relating to the Program and/or these Terms:

• YOU ARE GIVING UP YOUR RIGHT TO HAVE A TRIAL BY JURY; AND
• YOU ARE GIVING UP YOUR RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL, OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS, IN ANY LAWSUIT INVOLVING ANY SUCH DISPUTE.

9. GENERAL TERMS.  These Terms (including RentSpree’s Privacy Policy and Terms of Service) constitute the entire agreement between you and RentSpree concerning your use of the Program. The failure of RentSpree to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.
